The effort to transform America’s food system under Health and Human Services Secretary Robert F. Kennedy Jr.’s “Make America Healthy Again” (MAHA) agenda is gaining momentum, but much of that progress is happening in state capitals rather than Washington, D.C, according to Bloomberg Law. Across the country, state lawmakers have introduced legislation targeting food additives, school meals, nutrition standards and government food-assistance programs.
In 2026 alone, more than 100 food-related bills were introduced, with at least 11 becoming law, according to a recent analysis by KFF. That activity follows nearly 200 MAHA-related measures introduced in state legislatures during 2025, with at least 16 enacted. In doing so, this activity has not only aligned with Secretary Kennedy’s agenda but rather moved it forward at a more rapid pace.
More States Are Taking The Lead
As more states look toward enacting policies that allow for healthy options for families, some legislation has gone so far as to restrict what can be purchased using food assistance. The restricted items include buying candy or soda. In the case of states like West Virginia, the hope is these new initiatives will extend beyond a current generation.
Evan Worrell, a delegate from West Virginia who has backed a new law that will also support several nutritional initiatives. As stated in the Bloomberg Law piece, in “West Virginia, we don’t have great health outcomes,” Worrell explained, “but lawmakers are focused on changing that generationally.”
States are also looking to bring healthier options to students as they prepare to return to school in the coming weeks. This year, four states have banned school meals from containing certain color dyes or food ingredients. This initiative joins the eight other states that put this into motion in 2025.
